Recall Procedure for Recallable Long Term Firm:
Duke Energy Carolinas may recall all or a specified portion of the
transmission capacity reserved by each request under Schedule 7B of the Duke
OATT. This procedure addresses the key steps when a recall is executed.
Step 1: Duke Energy Carolinas
Duke Enegy Carolinas will notify one or more Existing Customer(s)
with recallable provisions in their Service Agreements that the Existing
Customer(s) have the amount of time specified in their Service Agreements to
respond to Duke Energy Carolinas' notice of recall. The
notification will specify the amount of capacity being recalled and the
effective date of the capacity reduction (or rate increase).
Step 2: Existing Customer (the customer with recallable
provisions in its Service Agreement)
1. Each Existing Customer must respond to the recall notification by
communicating its intention to Duke Energy Carolinas within the amount of
time specified in the Service Agreement to respond to Duke Electric
Transmission's notice of recall..
2. If electing to retain the
recalled capacity, the Existing Customer shall submit a MATCHING pre-confirmed
yearly OASIS request that starts on the effective date and equals the recalled
capacity. This request must be at the maximum tariff rate in effect for
this service, have the same end date as the recalled reservation and have the
ASSIGNMENT_REF of the recalled reservation in the RELATED_REF
field.
3. Failure to respond to a notice of recall within this time
period shall result in the release of the recalled capacity.
Step 3: Duke Energy Carolinas
- If the recalled capacity equals the capacity of the original
(recalled) reservation and the Existing Customer elects to retain it,
Duke Energy Carolinas shall accept the MATCHING pre-confirmed OASIS
request and execute a RECALL of all capacity in the original reservation from
the effective date of the capacity reduction to the end of the
reservation. The SELLER COMMENTS field of the RECALL shall indicate the
reservation was recalled in accordance with Schedule 7B of the Duke OATT and
displaced by the matching reservation. Rollover rights will be available
for the matching reservation and shall be equal to the full amount of the
original reservation.
- If the recalled capacity equals the capacity of the original
(recalled) reservation and the Existing Customer elects to release
it, Duke Energy Carolinas shall execute a RECALL of all capacity
of the original as recalled in accordance with Schedule 7B of the Duke
OATT. Rollover rights will be terminated for the original reservation.
- If the recalled capacity is only a portion of the capacity of the
original (recalled) reservation and the Existing Customer elects to retain
it, Duke Energy Carolinas shall accept the MATCHING
pre-confirmed OASIS request and shall execute a RECALL on the original
reservation, posting the amount and time frames over which the original
reservation's capacity is being reduced. Rollover rights will be
available for the MATCHING reservation plus the remainder of the recalled
reservation and shall be equal to the full amount of the original reservation.
- If the recalled capacity is only a portion of the capacity of the
original reservation and the Existing Customer elects to release it,
Duke Energy Carolinas shall execute a RECALL on the original reservation
and post the amount and time frames over which the original reservation's
capacity is being reduced. Rollover rights will be decremented by
the amount of capacity relinquished.
